These Terms of Service (“Terms”) govern your access to and use of PetTalk AI — the website at www.mypetsing.com and the AI pet video, photo and audio tools available on it (the “Service”). Please read them carefully. By accessing or using the Service you agree to be bound by these Terms and by our Privacy and Cookies Policy.

1. Acceptance of these Terms

By accessing, browsing or using the Service — including by creating an account, uploading a photo or audio, using a free generation, or paying for a plan or pack — you confirm that you have read, understood and agree to these Terms. If you do not accept all of these Terms, you must not use the Service. In these Terms, “we”, “us” and “our” refer to the operator of PetTalk AI, and “you” and “your” refer to the user of the Service.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and fully capable of entering into a binding agreement to use the Service. If you use the Service on behalf of a company or other legal entity, you represent that you are authorised to bind that entity, and “you” includes that entity.

3. The Service and licence

The Service lets you turn photos and audio into short AI-generated videos, images and related materials, including talking pet videos, animated photos, AI pet portraits and playful audio interpretations.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for your personal or internal business purposes, within the functionality available to you. You may not:

• copy, modify, distribute, sell, sublicense, rent or lease any part of the Service;
• reverse engineer, decompile or attempt to extract the source code or models of the Service, except where permitted by law;
• circumvent technical limits, usage limits, security measures or access controls;
• use the Service to build a competing product or to resell access to the Service without our written consent.

4. Accounts

Some features require an account or an identifier stored in your browser. You are responsible for the accuracy of the information you provide, for keeping your access credentials confidential, and for all activity that occurs through your account. Notify us promptly at support@mypetsing.com if you suspect unauthorised use. We may suspend or refuse access if we reasonably believe these Terms, the law or third-party rights are being violated.

5. Plans, gems and payment

The Service may be used free of charge or on a paid basis, depending on the plan or pack you choose. Some features consume “gems”, a usage unit shown in the interface. The current plans, prices, gem amounts and the number of gems required for each action are shown on the Pricing section and on the payment page, and may change over time.

Payments are made on a prepaid basis. Card payments are processed by the WebPay acquiring service and, where applicable, by banks and other payment providers. By paying, you agree to the payment provider’s terms. We receive only the information needed to confirm and account for the payment and do not store full card numbers.

Gems are a limited, non-monetary usage unit. They have no cash value, are not a security or a means of payment, cannot be exchanged for money and are non-transferable except within the functionality we provide.

Where required, closing documents are issued to the details you provide. If you do not send reasoned objections within 5 business days, the paid access is considered provided and accepted.

6. Refund policy

The Service delivers digital, intangible results that are generated and made available immediately. Gems that have been spent on a generation are not refundable or restorable, because technical resources of the Service and its providers are consumed at that moment. A result is considered generated once processing is completed, regardless of whether you downloaded it or whether it met your expectations.

If a generation fails due to a fault on our side, or if you were charged twice, contact us at support@mypetsing.com with your account, the date, amount and payment method. Verified claims are resolved by refund or by restoring gems. Refunds are made to the same payment method where technically possible; the time until the funds appear depends on the bank or payment provider. Statutory consumer rights are not affected.

7. User content and authorization

You keep ownership of the photos, audio and text you upload (“User Content”). By uploading User Content, you grant us a limited licence to process, store and transmit it solely to provide the Service and generate your results.

You represent and warrant that:

• you own the User Content or have all necessary rights, consents and permissions to use it;
• if an image or voice sample depicts another person, you have that person’s informed consent to use it for AI content generation;
• your User Content does not infringe intellectual property, privacy, publicity or any other rights of third parties, and does not violate any law.

You are solely responsible for your User Content. Do not upload content that you do not have the right to use.

8. Acceptable use and prohibited content

You must not upload, generate or use the Service to create content that:

• is unlawful, infringing, defamatory, fraudulent or misleading;
• depicts or exploits minors in any harmful or sexual way;
• promotes violence, terrorism, extremism, hatred or discrimination;
• harasses or harms any person, or impersonates a real person without their consent;
• contains another person’s personal data or image without a lawful basis;
• contains malware, spam, or attempts to disrupt or abuse the Service.

We may remove content and suspend or terminate access if we reasonably believe these rules are breached.

9. AI-generated results and ownership

Results are generated automatically by AI from your inputs, prompts and settings. They may not match your expectations, may not be unique, and may be similar to content generated for others. You must review each result before publishing or using it, including for compliance with advertising, intellectual-property and personal-data rules.

Subject to applicable law and to the rights of third parties, and to the extent permitted, you may use the results you generate for any lawful purpose, including commercial use, without crediting us. Where a result qualifies as an object of intellectual property, we assign to you, to the maximum extent permitted by law, the rights we may hold in it. You are responsible for how you use the result.

10. Third-party services

The Service relies on third-party services, including AI processing, hosting, analytics, error monitoring and payment providers such as WebPay. We are not responsible for the content, terms or practices of third-party services. Your use of a third-party service may be subject to its own terms and privacy policy.

11. Disclaimer of warranties

The Service and all results are provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or secure, or that any result will meet your requirements.

12. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising from or related to your use of, or inability to use, the Service. Our total aggregate liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the 3 months preceding the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

13. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses and expenses (including reasonable legal fees) arising from your User Content, your use of the Service, or your breach of these Terms or of any third-party right or applicable law.

14. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or other users. Upon termination, the licence granted to you ends; sections that by their nature should survive (including ownership, disclaimers, liability and governing law) will survive.

15. Changes to these Terms

We may update these Terms from time to time. The current version is always published on this page with the effective date shown above. If you continue to use the Service after an update, you accept the updated Terms.

16. Governing law and disputes

These Terms are governed by the laws of the Republic of Belarus, without regard to conflict-of-law rules. Before going to court, we ask you to contact us at support@mypetsing.com so we can try to resolve the dispute. Disputes that cannot be resolved amicably are resolved in accordance with the applicable law of the Republic of Belarus. Mandatory consumer-protection rules of your country of residence remain unaffected.
